Folsom Travel Agent Terms and Conditions
Sea Escape TRAVEL Folsom Travel Agent facilitates the purchase by customers (“Customers”) of travel related services, accommodations, Transportation, Entertainment, recreation and travel packages (collectively, “Travel Related Services”), which Travel Related Services are provided by providers (“Service Providers”) unrelated to and having no connection to Sea Escape TRAVEL Folsom Travel Agent.
In utilizing the services of Sea Escape TRAVEL Folsom Travel Agent to book, reserve and pay for Travel Related Services, you, the customer (“Customer”), agree to be bound by these terms and conditions (“Terms & Conditions”) which describe the terms and conditions by which Sea Escape TRAVEL Folsom Travel Agent and its partner wholesalers will agree to provide its services to Customer.
AGREEMENT
Acceptance: A deposit for a booking constitutes Customer’s acceptance of these Terms & Conditions.
Deposit: Bookings require a minimum $300.00 per person deposit to hold reservations. Some tours will require a larger deposit. Customer will be notified if a larger deposit is required. Deposits are NON-REFUNDABLE.
Payment: Full payment is due 45 days prior to departure. Some tours or accommodations require earlier payment. Customer will be notified if earlier payment is required. If the full payment is not paid by the stipulated date, Sea Escape TRAVEL Folsom Travel Agent reserves the right to cancel the booking(s) without further notice and without refund of deposit.
Changes: Once a deposit has been received, a $30.00 per-booking change fee will apply. Other fees are at the discretion of the hotels, tour operators, rental car agencies and other Service Providers. Cancellations:
Cancellation penalties may vary depending on the products booked. Customer cancellation before the full payment due date will incur loss of the non-refundable deposit as specified above. Customer cancellation on or after the full payment due date, but more than 7 days prior to departure, will incur a penalty equal to 50% of the total booking cost. Sea Escape TRAVEL Folsom Travel Agent will make no refunds for Customer cancellations made less than eight days before departure or subsequent to travel commencement. Other cancellation fees or refunds for Customer cancellation are at the discretion of the hotels, tour operators, rental car agencies and other Service Providers with which Customer has reserved Travel Related Services. Insurance purchases are NON-
REFUNDABLE.
Cancellation Fees (Land): Cancellation fees will be levied relative to the amount of notice given, as follows (minimum per person US$300):

Clients purchasing a campaign package special must adhere to the following terms and conditions:
Payment: Full payment is due at time of booking your vacation. Customer will be notified if earlier payment is required. If the full payment is not paid by the stipulated date, Sea Escape TRAVEL Folsom Travel Agent or our wholesaler(s) reserves the right to cancel the booking(s) without further notice and without refund of deposit. Prices are not guaranteed until full payment has been made.
Packages are 100% non refundable/non changeable once paid for in full. Package Pricing: A US$50 fee will apply if changes are made to the package before deposit. Cancellation: Once paid in full, all services are NON REFUNDABLE. We strongly recommend you purchase travel insurance to offset any penalties you may incur. Insurance: Travel insurance is STRONGLY RECOMMENDED. Travel insurance can be purchased to cover all penalties in the event Customer needs to cancel or change the Customer’s travel plans. Travel insurance can provide medical and emergency assistance protection during travel, as well as provide some loss and delay coverage. Absent insurance, all hospital and medical expenses are the Customer’s/traveler’s responsibility and Customers/travelers will not receive any refund (total or partial) for money paid. Travel insurance is available through Sea Escape TRAVEL Folsom Travel Agent or through our wholesaler partners.
Prices: Sea Escape TRAVEL Folsom Travel Agent quotes prices in US currency based on the exchange rates for the respective foreign currency, as provided by our wholesale partners, as of the date of the quote. Exchange rates fluctuate. Customer’s exchange rate is only fixed when full payment is made, unless otherwise noted on Customer’s itinerary. Any price that Sea Escape TRAVEL Folsom Travel Agent quotes is subject to change without notice until full payment is made, unless guaranteed in writing with a specific expiration date.
Children: Be aware that some travel products do not allow children below a certain age. If Customer plans to travel with children, Customer must notify Sea Escape TRAVEL Folsom Travel Agent when booking.
Passports/Visas: A passport valid for six months beyond the date of return travel is required for entry into most worldwide locales & all South Pacific countries. US and Canadian citizens require an Electronic Travel Authority to enter Australia. Sea Escape TRAVEL Folsom Travel Agent will process on request (see notes at bottom). Customers/travelers with a passport from a country other than the US or Canada should request information regarding any necessary documents from the destination countries’ consulates or their travel agents.
Limitation of Liability: Sea Escape TRAVEL Folsom Travel Agent shall not be liable for any claims, losses, damages, costs, expenses, delays, sickness, injury, or loss of enjoyment, of any nature or kind whatsoever, resulting from events beyond Sea Escape TRAVEL Folsom Travel Agents’ or a Service Provider’s reasonable control. In no event will Sea Escape TRAVEL Folsom Travel Agents’ liability exceed the total amounts Customer paid Sea Escape TRAVEL Folsom Travel Agent for Customer’s travel. Sea Escape TRAVEL Folsom Travel Agent assumes no responsibility for lost tickets, documents, passes, or coupons.
Relationship of the Parties: Sea Escape TRAVEL Folsom Travel Agent shall be deemed to be an independent contractor for all purposes under these Terms & Conditions. Sea Escape TRAVEL Folsom Travel Agent is acting solely to facilitate the reservation and purchase of Travel Related Services and is not acting in any other capacity with either the Customers or the Service Providers, including, but not limited to, any partnership, joint venture, co-ownership, or agency relationship of any kind with any Customer or Service Provider. Sea Escape TRAVEL Folsom Travel Agent does not have any control over the quality, timing, safety or legality of any Travel Related Service actually reserved or purchased by or for a Customer. Sea Escape TRAVEL Folsom Travel Agent does not and cannot control whether or not a Service Provider represents its products accurately or fulfills any agreement or obligation with any Customer.
Disputes & Indemnity: As Sea Escape TRAVEL Folsom Travel Agent is not involved in providing the Travel Related Services for the Customer, any and all disputes between a Customer and Service Provider are solely between that Customer and that Service Provider, and the Customer and Service Provider should handle all such disputes directly with that Customer or Service Provider. If Service Provider or Customer contacts Sea Escape TRAVEL Folsom Travel Agent or a partner wholesaler relating to any dispute between the Customer or Service Provider, Sea Escape TRAVEL Folsom Travel Agent may, in its sole discretion, facilitate dispute resolution and reserves the right to take any action that Sea Escape TRAVEL Folsom Travel Agent deems appropriate under the circumstances. Customer agrees to release Sea Escape TRAVEL Folsom Travel Agent and its agents and employees from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. Furthermore, Customer agrees to indemnify, defend and hold harmless Sea Escape TRAVEL Folsom Travel Agent from any liability, loss, claim and expense, including reasonable attorney’s fees, arising out of or in any way connected with such disputes.
Validity: These Terms & Conditions are valid until further notice in writing from Sea Escape TRAVEL Folsom Travel Agent.
FULLY-ESCORTED SERIES
Fiji: If numbers do not reach 20 on tours E22F, E28, E14F and E55F in Fiji, touring will not be escorted by Tour Director.
Land Only Fares: Subject to availability and all transfers at passenger’s own expense.
Fares Guarantee: In recent times it has become necessary to accept that it is unrealistic to expect prices to remain stable—particularly when they are dependent on foreign currency exchange rates. Land fares in this brochure are per person and based on rates expected to be prevailing at the time of printing, but are subject to increase without notice if these rates change substantially. The current fare will be con?rmed to your travel agent at the time you book your tour; once we have accepted your deposit, the tour portion of the fare is guaranteed, and any subsequent increases are not expected or normal.
Airfares Within Australia: Fares shown do not include airfares (unless stipulated in itinerary). Special airfares for travel within Australia are available to overseas visitors, subject to availability. Your travel agent will be able to advise you.
International Air Travel: Qantas is the preferred partner for international air travel and all prices reflect Qantas as the international air carrier. The land price (which includes all domestic flights in Australia and New Zealand) will differ if other international carriers are used. APT has special prices for international air on specific flights with Qantas. When these specific flights booked complimentary arrival transfer will be provided. Please ask at time of booking.
Luggage Limits: For escorted tours, each passenger is entitled to take one piece of luggage. On all coach tours (rather than independent modules) of 3 days or more, a travel bag is issued upon boarding the coach. Maximum weight of all baggage is 20 kg (44 lbs).
Single Rooms: Single rooms are available and may be requested at the time of booking and prepaid at the cost specified. However, for those not wanting to pay such a supplement, it is possible on most tours for us to offer a ‘match-up’ service with another passenger traveling alone so that a twin-bedded room may be shared.
Validity of Fares: All fares in this publication are effective from 1 April 2012 to 31 March 2013. Fares prior to 1 April 2012 may be different to those indicated. Please note surcharges and minimum night stays may apply and itineraries may vary due to special events, such as New Year’s Eve, Christmas, Melbourne Cup, and other special event periods in each country.
Days of Notice prior to tour commencement:
43 or More: Loss of Deposit; 42–4 days: 50% of tour total; Within 4 days: 100% of tour total
If tour has commenced, no refund of fare or unused portion. We guarantee to refund in full any service which has not been delivered satisfactorily, provided you have given us every chance to rectify the situation by notifying your Tour Director immediately at the time. If still unsatisfied, we ask you to state in writing your reason, within 30 days for consideration.
Air Transportation: Airfares are subject to change without notice. Australian Pacific Touring guarantees the airfare in effect on the day full payment is received from your travel agent. If flight schedules are changed beyond the control of Australian Pacific, any increase or additional costs will be collected from passengers. Cancellation charges may be imposed after ticketing deadline.
Important
To enter Australia, you must possess a passport valid for 6 months beyond your return date to the US. An Electronic Travel Authority (ETA) is required to enter Australia and must be obtained before you depart. Your ETA can be issued by Sea Escape TRAVEL Folsom Travel Agent for US$20 per person if you are a US/Canadian citizen without a criminal record. Others must contact an Australian consulate or Embassy. NOTE: An ETA does not guarantee you entry into Australia. It is the travelers responsibility to divulge any information pertaining to, but not limited to, a criminal record, health records and all other reasons that may impede your entry into Australia.
